1. Acceptance of terms
These Terms and Conditions ("Terms") form a contract between you ("User," "you") and Artecnology LLC ("Sonus," "we"). By creating an account, installing, or using the Sonus application or service (the "Service"), you accept these Terms and our [Privacy Notice]. If you do not agree, do not use the Service.
2. Definitions
- Service: the Sonus application, website, and features, including music analysis and adaptation and optional calibration.
- Calibration: the optional reading, via camera and/or microphone, of your expression, a heart-rate signal, and your voice, from which the Service infers your arousal and an orientative profile.
- User Content: data, settings, or material you provide.
- Third-Party Content: music, catalogs, or services provided by third parties.
3. Eligibility and age
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service, or 13 years old with verifiable consent from your parent or guardian where the law permits. The Service is not directed to minors below that threshold. You represent that the information you provide is accurate.
4. What Sonus is — and what it is not
- Sonus is a wellbeing and entertainment tool that personalizes music. Its purpose is to help you regulate your sound experience based on your profile and your response.
- Sonus is NOT a medical device or a healthcare service. It does not diagnose, treat, cure, or prevent any disease or condition, whether physical or mental, and does not replace consultation, diagnosis, or treatment by qualified health professionals.
- The inferences about arousal, emotion, and personality are statistical approximations, not clinical measurements. They do not detect lies, do not measure your real state precisely, and can be wrong. You should not make health, safety, employment, or financial decisions based on them.
- If you experience a crisis or significant distress, seek help from a professional or your country's emergency services. The Service is not a crisis line.
5. Accounts (if applicable)
You are responsible for keeping your credentials confidential and for the activity on your account. Notify us of any unauthorized use at —. We may suspend accounts with false data or that breach these Terms.
6. Calibration, camera, microphone, and biometric data
- Calibration is voluntary and activates only if you start it and grant the camera and/or microphone permissions.
- By starting it, you give your explicit consent to the processing of biometric data and the inference of your emotional state/arousal, as described in the [Privacy Notice].

- You may revoke the permissions and consent at any time from your system or app settings. The Service will continue to offer you the features that do not require calibration.
- Sonus is an emotion-recognition system and must not be used in workplace or educational contexts to infer the emotions of people.
7. License to use
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.
8. Acceptable use
You agree not to: (a) use the Service unlawfully or for purposes prohibited by these Terms; (b) capture, infer, or calibrate biometric or emotional data of third parties without their consent; (c) use calibration in workplace or educational contexts to assess people; (d) decompile, reverse-engineer, or extract the code, except to the extent permitted by law; (e) circumvent security measures or usage limits; (f) introduce malware or overload the infrastructure; (g) resell or commercially exploit the Service without authorization.
9. Intellectual property
The Service, its software, design, trademarks, and content (excluding Third-Party Content and User Content) are owned by Sonus or its licensors and are protected by applicable law. You acquire no rights beyond the license in section 7. You retain ownership of your User Content; you grant us a limited license to operate it and provide you the Service.
10. Third-party content and services (music, catalogs, platforms)
The Service may integrate or play third-party music and content subject to their own licenses and terms. We are not responsible for such content or for third-party services (app stores, payment providers, streaming platforms). Your use of them is governed by their terms. 12. Disclaimer of warranties

We do not warrant that the arousal, emotion, or personality estimates are accurate, or that the Service will produce any specific effect on your mood or wellbeing. (This disclaimer does not limit non-waivable statutory warranties applicable to consumers — see section 17.)
13. Limitation of liability
To the maximum extent permitted by law, Sonus shall not be liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits or data loss. Our total aggregate liability is limited to [the amount you paid in the last 12 months / USD 100], whichever is greater. (None of this excludes liability that cannot be excluded by law, such as willful misconduct, gross negligence, harm to life/bodily integrity, or non-waivable consumer rights.)
14. Indemnification
You agree to hold Sonus harmless against third-party claims arising from your unlawful use of the Service or your breach of these Terms, to the extent permitted by law. (This clause does not apply, or applies in a limited way, to consumers in jurisdictions that restrict it.)
15. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or for legal or security reasons, with reasonable notice where possible. Upon termination, your license ends; clauses that by their nature should survive (e.g., intellectual property, limitation of liability) will remain in effect.
16. Changes to the Service and the Terms
We may modify the Service or these Terms. If changes are substantial, we will notify you via [EMAIL / in-app notice] with reasonable advance notice. Continued use after they take effect constitutes acceptance; if you do not accept, stop using the Service. (Where the law requires, we will obtain your express acceptance.)
17. Consumer rights (prevailing clause)
Nothing in these Terms limits the mandatory rights that your country's law grants you as a consumer. In particular:
- European Union / EEA: the consumer-rights, digital-content-and-services, and unfair-terms directives are respected; clauses that contravene them will not apply to you.
- Latin America: local consumer-protection laws are respected (e.g., PROFECO/LFPC in Mexico, the CDC in Brazil, the Consumer Statute in Colombia, the LDC in Argentina), and they prevail over any provision to the contrary.
- United States: certain rights cannot be waived under applicable state law.
18. Governing law and dispute resolution

- Force majeure: we are not liable for breaches due to causes beyond our reasonable control.

- Waiver: our failure to exercise a right does not waive it.
